Terms & Conditions of Service.

Scope of Work:

Photographer and Client are to arrive for the photo session at the agreed time and location which will be confirmed prior. Please refer to the invoice for details regarding inclusions, products, and fees.

Retainer and Payment:

Upon your signature, the Photographer will reserve the time and date agreed upon, and no other reservations or bookings will be made for that time and date. The Client shall make a non-refundable retainer of a session fee to the Photographer to perform the services specified in the invoice.

Upon payment, the Photographer will reserve the time and date agreed upon by both parties exclusively for you.

Your non refundable session fee retainer is due at the time of booking to secure your date. The full amount and any agreed upon additional travel fees or costs relating to the photo session must be paid to secure your date. No services will be made until full payment of the retainer / session fee is made.

Rescheduling/Late Arrival:

In the case of illness or other need to reschedule your session, there is no extra charge for moving a session once, if you have given at least 24 hours notice.

If for any reason you, your baby, children, or any member of your household is sick or unwell, please call to reschedule your session. No person feeling unwell will be admitted to the studio. We understand life happens and will always do our best to reschedule your session as appropriate.

If you need to reschedule for reasons of sickness, the price quoted at the time of booking will be honoured for 6 months only. After this time, any pricing increase will be applicable. If you need to reschedule your session and do not book in a future date, you will have a credit for funds paid, however any price changes will apply immediately. Any future rescheduling is subject to the availability of the Photographer.

Any Client who is late arriving to their session will have the remaining amount of time allotted for the session. All additional time beyond the scheduled end time will be at the Photographer’s discretion.

Prices are subject to change without notice and are non-negotiable. Prices at the time of your session are guaranteed for 30 days after your session.

Cancellation:

If the Client cancels this agreement less than 24 hours prior to the date of the photo session, or fails to show for a session, the Client forfeits all payments made to the photographer.

No refunds will apply to cancelled sessions. If for some reason you cancel your session or are a ‘no show’ without notice or prior attempt to reschedule, you forfeit your session fee.

No refunds will apply to pre-purchased gift vouchers under any circumstances.

Due to the custom nature of photography, strictly no refunds on either your session deposit, or your order total will be issued once the session has been held. This includes any prepayment of any funds that occur before the booked session itself.

Promotional offers may not be used in conjunction with other offers. Offers are not redeemable for cash or products.

Indemnification:

Photographer and Client agree that the Photographer is under no obligation to capture any specific moment or pose or person(s) during the photo session. The Photographer is not responsible for the compromised coverage due to causes beyond the control of the Photographer including but not limited to obtrusive guests, lateness of Client or guests, weather conditions, schedule complications, incorrect addresses provided to the Photographer, restrictions of the locations.

If the Photographer is unable to to perform the services in this contract due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God or any cause outside their control: the Photographer will make reasonable efforts to arrange a substitute photographer who is prepared to perform the services under this contract for the price agreed in this contract if the Photographer is unable to perform services. Photographer will return in full all payments made by the Client to the Photographer in relation to this photo session if a substitute photographer can not be arranged either on the originally agreed photo session date or at another mutually agreed upon date.

The Photographer reserves the right to substitute with another photographer in the case of failure to perform as stated above. The substitute photographer is chosen at the discretion of the Photographer and does not constitute a breach of this agreement. The Photographer warrants the substitute photographer to be of comparable quality and professionalism.

If the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, the Photographer will not be liable for any consequential loss arising from the non-delivery, and the liability of the Photographer to the Client should be limited to the repayment of amounts paid to the Photographer under this agreement.

The Client understands and agrees that the Photographer is not required to maintain copies of the photos from this photo session 14 days after the delivery of the Client’s purchased digital images to the Client. The Client will have 14 days after the purchased digital file delivery to make the Photographer aware of any issue, discrepancy, technical problem, or any other complaint regarding the photographs, their quality and contents, or anything relating to session coverage. After this 14 day term, the Photographer will not longer be liable to the Client for any corrections, refunds, re-edits, or re-shoots. Re-edits after this term may be made by the Photographer if requested by the Client but the hourly fee of $60 per hour plus GST for retouching will be billed with a minimum of one hour required.

The Client agrees to indemnify and hold the Photographer harmless for any and all personal injury which may occur during the course of the photography session and immediately surrounding the photo session (including any personal injury arising former connected with any negligent act or omission or accident on the part of the Photographer). The Client also agrees to indemnify and hold the Photographer harmless for any and all personal injury which may occur during the course of any interactions with the Photographer on location or in the Photographer’s home studio and surrounds.

Copyright and Reproductions:

Images are not to be used for commercial use without written consent by Shanon Quinn Photography.

The Photographer retains the right of discretion in selecting the photographic materials released to the Client.

The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer.

Shanon Quinn Photography/the Photographer reserves the right to use any photograph in any form such as, but not limited to, the use in advertising, marketing, reproduction, portfolio entries, sample studio products, editorial submissions, and use on the Photographer’s website, social media, and/or studio, and copyright. All images are copyrighted by Shanon Quinn Photography - even those you purchase. You will receive a Print Release for images that you purchase which allows you unlimited personal use and reproduction of those images.

We reserve the right to refuse any service at any time.
